By accessing the website at http://www.crewtracks.com, you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

Use License

Permission is granted to temporarily download one copy of the materials (information or software) on CrewTracks’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on CrewTracks’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This includes SMS messages for appointment scheduling, appointment reminders, follow up conversations, billing notifications, or service notifications. Message frequency varies. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Utah and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Privacy Policy

Your privacy is important to us. This Privacy Policy explains how CrewTracks (“we,” “us,” or “our”) collects, uses, communicates, discloses, and protects personal information when you use our website, web application, and mobile applications (iOS and Android), collectively referred to as the “Services.”

1. Our Role as a Service Provider (B2B Context)

CrewTracks provides field tracking software for businesses with field-based or mobile workforces. In this context, the business utilizing our software (the “Employer”) is the Data Controller, and they own and control the data entered into our system. CrewTracks acts as a Data Processor, operating on behalf of the Employer. If you are an employee using the CrewTracks mobile app, your Employer dictates what information is collected and how it is utilized within the app. This privacy policy covers use of the CrewTracks marketing website and use of CrewTracks Services as an employee or contractor of the Employer. The privacy policy for Employers is specified separately in a business services agreement between Employers and CrewTracks.

2. Information We Collect

We collect information by lawful and fair means to provide our Services. Depending on how your Employer configures CrewTracks, we may collect the following:

A. Information Provided by Employers and Users
  • Profile Information: To create an account, an Employer must provide a display name at a minimum. Employers may choose to add additional employee details (such as phone numbers or email addresses) to facilitate communication and tracking.
  • User-Generated Content: Data entered into the app, such as timesheets, job notes, and logs.
B. Information Collected via the Mobile App (Device Permissions)

To provide core functionalities, the CrewTracks mobile app requests specific device permissions. These features are often controlled and mandated by your Employer:

  • Location Data (Including Background Location): If enabled by the Employer, the app tracks GPS location. When enabled, CrewTracks collects precise location data to enable location-based timekeeping and jobsite geofencing, including detecting arrival at and departure from jobsites and sending related clock-in and clock-out reminders, even when the app is closed or not in use. This includes collecting location data in the background. To comply with platform requirements, a separate prominent disclosure and consent is provided within the app before we request the Background Location Permission. We use this data solely to provide CrewTracks services requested by the Employer to:
    • Track user location while actively clocked in
    • Log when users enter or exit designated jobsites (geofencing)
    • Send automated reminders to clock in upon arriving at a jobsite, or clock out upon leaving (geofencing)
    • Store the location where jobsite photos are taken
  • Camera and Media Library: The app requests access to your device’s camera and photo library so users can take and upload photos of jobsites, receipts, or clock-in verification photos.
  • Facial Recognition (Biometric Data): If enabled by your Employer, the app utilizes facial recognition technology for clock-in verification. We use a facial recognition model to compare a real-time clock-in/out photo to the user’s established profile photo. This data is used solely for identity verification for timesheet accuracy. After the app checks if the profile photo matches the clock photo, any facial recognition data is discarded other than whether there was a match.
C. Automatically Collected Information
  • Device and Usage Data: We use diagnostic and logging services to monitor mobile app performance, diagnose crashes, and improve stability. This may collect anonymous device information and crash logs.
  • Website Tracking: Third parties may place cookies on your browser for targeted advertising purposes when visiting our marketing website. Data collected may include IP addresses, cookie identifiers, and website activity. To learn more or opt-out, visit https://www.aboutads.info/. 3. How We Use the Information

We collect and use personal information solely for fulfilling the purposes specified by us, your Employer, and for providing the CrewTracks Service. This includes:

  • Providing, operating, and maintaining the Services
  • Verifying identity and location for timesheet and payroll accuracy
  • Sending transactional messages, such as SMS notifications
4. How We Share Information

We do not sell your personal data and we do not use your data, including location data for any advertising purposes. We only share information in the following circumstances:

  • With the Employer: As the owner of the data, your Employer has full access to the information collected via your use of the CrewTracks app
  • With Service Providers: We utilize trusted third-party service providers to operate our business, including:
    • Cloud Hosting Provider: For secure cloud data storage, processing, and facial recognition processing
    • SMS Services: To facilitate SMS messages sent by Employers to their employees
    • Diagnostic and Logging Services: For tracking and logging errors, warnings, and user behavior used to improve the CrewTracks Service
  • Legal Requirements: As required by law, such as to comply with a subpoena or similar legal process
  • Statistical Reporting: We may share de-identified and/or aggregated data for purposes such as service improvement, statistical analysis, and internal or external reporting

SMS Consent Policy: Any SMS consent or phone numbers collected are strictly used for providing the CrewTracks service. SMS consent and phone numbers are not shared with third parties or affiliates for marketing purposes.

5. Data Retention and Deletion

We retain personal information for as long as necessary to fulfill the purposes outlined in this policy or as directed by the Employer.

How to Request Data Deletion:

Because CrewTracks is a processor of your Employer’s data, employees should generally direct data deletion or modification requests to their Employer.

However, users or Employers may directly request account deletion and the deletion of associated personal data by contacting our support team at:

Upon receiving a verified request, and in coordination with the respective Employer where applicable, we will delete or anonymize your personal information from our active databases. Such data may still be retained in backup and/or archival systems.

6. Security

We protect personal information by using reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. All app and user data is hosted in a secure cloud provider environment.

7. Changes to this Privacy Policy

CrewTracks may change this privacy policy from time to time at CrewTracks’s sole discretion. We encourage users to frequently check this page for any changes.
